[edit] What is a People's Mandate?

The People’s Mandate is a direct instruction to the Victorian Government from the Sovereign People who create the Government. As the stream never rises higher than the source, so government can never rise higher in authority than the people who create it. As is aptly quoted in the preamble section of The Annotated Constitution of the Australian Commonwealth, Quick & Garran, ‘supreme, absolute and uncontrollable authority remains with the people’ and ‘The members of that body are called the “sovereign people”, and every citizen is one of this people and a constituent member of the sovereignty.’ Page 286 2001 Edition.

The People’s Mandate is a vital tool in the hands of the people to bring to heel excesses of government when that government is acting in clear violation to the welfare and will of the people in an affected area. This is clearly the case in the Mornington Peninsula region with respect to the proposed Channel Deepening of Port Phillip Bay and proposed port development of Western Port.

A People’s Mandate differs from a petition in that a petition is essentially a plea to do or not do a particular thing. There is no power in a plea other than the hope that the government may be swayed by the views of a particular group of people. The mandate on the other hand is a direct order to government (the servant) from the Sovereign People (the supreme authority) to do or not to do a particular thing. Any government that violates a direct mandate from the Sovereign People it serves does so at its extreme peril and thereby loses any right it may have to continue as a valid government of the people. It has attempted to usurp authority and power that is not vested in it.

[edit] The Mornington Peninsula Mandate

The People of the Mornington Peninsula Shire have an opportunity to sign such a Mandate.

Three copies are required to be signed and returned to the Mornington Peninsula Mandate Committee.

All those people within the shire who are of voting age will be able to participate, and must be permanent residents, living six months or more of the year within the Mornington shire boundaries.

I, ......................... a duty qualified sovereign man/woman of the Commonwealth of Australia, acting within my full capacity, hereby MANDATE the Victorian Parliament and State Government to withdraw from all negotiations with regard to proposed Channel Deepening works to be carried out at Port Phillip Bay: the entrance to Port Phillip Bay, the Heads, and the Rip, the shipping lanes, channels and surrounds of Port Phillip Bay, and Yarra River, and within the boundaries of the area known as the Mornington Peninsula Shire.

In withdrawing from such arrangements, I further MANDATE that the Victorian Parliament and State Government not enter into any negotiations with any entity to establish and like processes or services anywhere in the same region, or the surrounds of Port Phillip, or Westernport Bay.

This MANDATE is to be carried into full effect of the law within ninety (90) days from the delivery of this MANDATE to the Victorian Parliament and State Government.
